Rents Are Softening: Why Offering a Free Month Can Beat Cutting Your Rent (Ontario Rules)

Quick answer: If your unit won’t rent at last year’s price, a permanent rent cut lowers your lawful rent, the base that all future increases are calculated from. Ontario allows certain discounts that don’t lower lawful rent: a prompt-payment discount of up to 2%, and, in writing, rent-free periods of up to three months in a 12-month period, or a discount of up to one month’s rent in the first eight months. Used properly, a free month can fill a vacancy now without shrinking your rent for years.

Key takeaways

  • Toronto rents have fallen from their peak, and many condo landlords face longer vacancies.
  • One empty month costs as much as one free month, so speed matters.
  • Units first occupied after November 15, 2018 are exempt from the annual rent increase guideline, which changes the math.

Lawful rent in plain English

Your lawful rent is the rent you can legally charge and the amount future guideline increases apply to. If you lower the rent permanently, the new, lower rent usually becomes the lawful rent. If you give an allowed discount, the lawful rent can stay at the full amount.

The discounts that keep lawful rent intact

Discount Limits
Prompt-payment discount Up to 2% for paying on time or early. Can be written or verbal.
Rent-free periods Up to 3 months of free rent in a 12-month period, in writing.
One-month discount A total discount of up to 1 month’s rent during the first 8 months of a 12-month period, in writing.
Combination Up to 1 month’s rent in the first 7 months, plus up to 1 month rent-free in the next 5 months, in writing.

Discounts outside these rules can reduce your lawful rent, so get them right. Write any discount into section 7 of Ontario’s Standard Lease.

The math: free month vs rent cut

Example: a $2,600 per month condo that isn’t renting.

Option Cost in year 1 What happens after
Cut rent by $100 (to $2,500) $1,200 Lawful rent drops to $2,500. You lose $1,200 every year after, plus guideline increases calculated on the lower amount.
One free month (lease at $2,600) $2,600 Lawful rent stays at $2,600. From year 2, you earn the full rent.
Stay empty one more month $2,600 No tenant yet, and the cost keeps growing.

If the tenant stays more than about two years, the free month usually comes out ahead. For a post-2018 unit (no guideline cap), you can raise rent to market on renewal anyway, so the difference is smaller, but a free month still avoids setting a lower starting point.

Pricing a rental in a softer market

  • Price against active listings, not last year’s leases. Tenants compare what is available today.
  • Watch days on market. If similar units are leasing in 2 to 3 weeks and yours has been listed for 6, the price or presentation is off.
  • Presentation matters. Professional photos, a clean unit and flexible move-in dates rent faster.
  • Consider furnished or longer leases if they suit your building and tenant pool.

Rules to stay on the right side of

  • No late fees or penalties for late rent. They aren’t enforceable in Ontario.
  • Rent increases need proper written notice and, for most units, can only happen once every 12 months.
  • Several Residential Tenancies Act changes took effect on September 21, 2026. Make sure your notices and processes are current.

FAQ

Does a free month have to be in writing?
Yes. Apart from the up to 2% prompt-payment discount, discounts need to be in writing to keep the lawful rent intact.

Can I take the free month back if the tenant leaves early?
Talk to a paralegal or lawyer before adding conditions to a discount. Get the wording right from the start.

Is my unit exempt from rent control?
Units first occupied for residential purposes after November 15, 2018 are exempt from the annual guideline. Other rules, such as notice requirements, still apply.
